§ 22-6. Develpoment within street rights-of-way that dead-end into public trust areas.

  • (a)

    In accordance with the local authority granted under Session Law 1998-83 and the general authority granted under NCGS 160A-300, the town shall not make improvements within street rights-of-way that dead end into public trust areas other than the placement of traffic control devices as defined under section 28-1 of this Code and customary right-of-way maintenance unless the town council has adopted an ordinance that (1) identifies the nature of the proposed use to be made within such right-of-way; (2) describes any anticipated improvements to be made within such right-of-way; and that (3) specifies the manner in which the right-of-way shall be regulated to accommodate the improvements or use.

    (b)

    Bulkheading and/or associated access stairways on property abutting public trust areas provided for under section 14-1 of this Code is an example of an ordinance and the type of improvements contemplated by subsection (a) above. Other improvements within municipal rights-of-way that dead-end into public trust areas are also allowed, provided they are developed in accordance with the general standards contained within sections 15A NCAC 07M.0301 through 15A NCAC 07M.0307 of the State of North Carolina's Shorefront Access Policies, as the same may be amended or modified from time to time.

    (c)

    Regulation of parking, vehicular and pedestrian traffic for street-end of SW 6 th street.

    (1)

    SW 6th Street is a public street that ends immediately north of the northern boundary of the mean high water mark of Davis Canal. Regulating on-street parking, vehicular and pedestrian traffic in this area will promote the general health, safety and welfare of the public.

    (2)

    In accordance with the authority granted under NCGS § 160A-300, NCGS § 160A-301 and section 22-6 of the Town's Code of Ordinances, the town hereby adopts this section to implement the installation of the improvements depicted on the attached exhibit "A" to regulate on-street, vehicular and pedestrian traffic in this area. Said installation shall be conducted in such a manner as to not interfere with the public's right of ingress and egress from SW 6th Street.

    (3)

    Any vehicle parking in a marked on-street parking space shall be entirely within the lines or markings of the marked parking space.

    (4)

    It shall be the responsibility of the police department and public works department to enforce this section.
