§ 24-4. Collection of solid waste fees.

(a)

The monthly solid waste fee, which shall include the monthly fixed fee, plus any user fees where such are incurred and applicable to the billing period, shall be billed by the town on the customers' utility bills or shall be directly billed to those customers that are not provided water and/or sewer service by the town. (The term "customer," as used in this chapter, is defined as the property owner, renter or other legally authorized occupant of a property.)

(b)

Solid waste fees included on utility bills shall be payable within the time limit fixed for the payment of the utility bill. Fees directly billed to nonwater or nonsewer users shall be required to be paid within a comparable time limit as to that fixed for the payment of the utility bills.

If such fees are not paid as provided in this section, the town may discontinue any or all solid waste services for that facility, and the further retention of such solid waste on the property involved shall be unlawful and shall subject the customer, and the owner of the property, if otherwise, to all applicable health and sanitation regulations and laws. Also if such fees are not paid as provided in this section, in accordance with 160A-314.1(b), such fees may be added to that property owner's property tax bill and, in such case, shall become payable in the same manner as property taxes, and in the case of nonpayment, shall become subject to collection in the same manner as delinquent property taxes as provided in division 4, article II of chapter 10 pertaining thereto.

Partial payments (re: those customers who are being provided utility bills with the solid waste fees thereon). As authorized by G.S. 160A-314(b), the town specifies by ordinance the order in which partial payments are to be applied among the various enterprise services covered by a bill for the services. Any partial payments made to the town for solid waste and utility services shall first be applied toward payment of the solid waste fees. The remaining uncollected balance shall then be applied toward payment of the applicable utility billing and shall be collected as prescribed for town water and wastewater in article II of chapter 30.
