§ 10-51. Application.

  • A person shall apply to development services' zoning administrator or designee for each license required by this article no less than ten days before the commencement of sales. The application, which shall be submitted on forms provided by the zoning administrator, shall contain the following:

    (1)

    The name of the applicant and whether the applicant is an individual, a partnership, a corporation or some other entity.

    (2)

    The nature of the business. If the nature of the business is the sale of malt beverages or fortified or unfortified wine, it must be shown which of the following is being conducted:

    a.

    On-premises malt beverage, off-premises malt beverage, or both;

    b.

    On-premises unfortified wine, off-premises unfortified wine, or both;

    c.

    On-premises fortified wine, off-premises fortified wine, or both.

    (3)

    Where the business is conducted, or to be conducted.

    (4)

    An address where notices and statements may be mailed to (the applicant) as required by this article.

    (5)

    Whether the business is regulated by a state occupational licensing board subject to G.S. ch. 93B, and if so, the serial number of the state license the applicant currently holds.

    (6)

    The telephone number where the applicant or business may be contacted.

    (7)

    When the business to be conducted is itinerant merchant/itinerant salesman or peddler, the application must include proof that a current state license is held by the applicant.

    (8)

    The building inspector's and fire marshal's certification.

    (9)

    Written statement signed by the owner or lessee of any property upon which the itinerant merchant, vendor or peddler offers goods for sale. The statement must clearly state the name of the owner or lessee, the location of the premises for which the permission is granted, and the dates during which the permission is valid. The statement must be conspicuously and prominently displayed, so as to be visible for inspection by patrons of the itinerant merchant or peddler, at the places or locations at which the goods are to be sold or offered for sale.

    (10)

    Any other information the zoning administrator determines to be necessary to compute the amount of fee due for the approval of the license.
